Legal guarantee of conformity
Your free two-year rights against the Belgian seller, the Belgian two-year presumption, updates and remedies.
A two-year legal guarantee
Any consumer good sold to a consumer benefits from the two-year legal guarantee of conformity from delivery, provided by the Civil Code (former articles 1649bis and following, as reformed on 1 June 2022). This guarantee is free and mandatory: no term may reduce or exclude it. The seller is liable for the lack of conformity existing at the time of delivery and appearing within the two-year period.
The Belgian two-year presumption
Since the reform, any lack of conformity that appears within two years of delivery is presumed to have existed at the time of delivery. Belgium extended this presumption from the former six months to a full two years. In practice, for two years it is for the seller to prove the defect did not exist at delivery, not for the consumer to prove the opposite.
Your remedies
Where there is a lack of conformity, you are entitled first to have it brought into conformity free of charge, by repair or replacement, within a reasonable time and without major inconvenience. If that is impossible, disproportionate, delayed or repeated, you may ask for an appropriate price reduction or termination of the contract, unless the defect is minor. The costs of return, labour and materials are for us to bear. Any refund due is made within fourteen days.
Notification and handling
Report the defect to gilles.capelluto@molderez-consult.be, describing the problem and including the order reference. We arrange the bpost collection and you follow the case in your language. It is recommended to inform us of the defect within two months of noticing it. The guarantee does not cover normal wear, misuse, accidental damage or unauthorised changes; these limits never reduce your legal rights.
Goods with digital elements and updates
The EBO and ROLA robots contain digital elements (embedded software, app, services). The seller must ensure that the updates needed to keep the goods in conformity and secure are supplied to you for the period you may reasonably expect, or for the period set in the contract for a continuous supply. The absence of these updates is a lack of conformity. The end-of-support date announced by the manufacturer is published on the product sheet.
Optional extension and manufacturer guarantee
An optional contractual third year may be offered. It adds to the two-year legal guarantee and never replaces it. Any commercial guarantee from the manufacturer (Enabot) is separate, governed by its own terms, and does not affect or replace the legal guarantee you hold against MEO Safety as the Belgian seller.
